Terms of Use for CERTENTIC Bridge

Open Beta Notice

CERTENTIC Bridge is currently in an Open Beta phase. Use of the service is free of charge during this phase.

CERTENTIC may modify or discontinue the Open Beta at any time. Free use during the Open Beta does not create any entitlement to continued free use.

If CERTENTIC Bridge is offered as a paid service in the future, a separate agreement will be required. Participation in the Open Beta will not automatically convert into a paid contractual relationship.

Section 1 Scope, Provider and Formation of Contract

1. These Terms of Use apply to the use of CERTENTIC Bridge.
2. The provider is:

3. Registration is required to use CERTENTIC Bridge. Registration may take place in advance or as part of connecting a supported AI service or supported application to CERTENTIC Bridge.
4. As part of the registration process, you confirm your acceptance of these Terms of Use.
5. The contract for the use of CERTENTIC Bridge is concluded when, after completing registration, you authorise the connection of a supported AI service or supported application to CERTENTIC Bridge for the first time.
6. The technical creation of a user account before this first authorisation does not, by itself, result in the conclusion of a contract for the use of CERTENTIC Bridge.

Section 2 Eligibility

1. You may use CERTENTIC Bridge only if you are at least 18 years old and have full legal capacity.
2. If you use CERTENTIC Bridge on behalf of a company or other organisation, you must be authorised to do so.

Section 3 Scope of Service

1. CERTENTIC Bridge enables supported data sources to be connected to supported AI services and applications and allows data to be made available for requests initiated by the user.
2. The data sources, AI services, applications and functions currently supported are specified in the current product description of CERTENTIC Bridge.
3. CERTENTIC Bridge currently supports, in particular, read-only access to iCloud Mail and iCloud Calendar.
4. CERTENTIC Bridge currently does not create, modify, send, move or delete emails or calendar entries.
5. CERTENTIC Bridge is an independent service provided by CERTENTIC GmbH. CERTENTIC Bridge is not a product of Apple or of the providers of connected AI services and is not operated by them.
6. CERTENTIC provides the technical connection and the requested data. CERTENTIC has no control over how a connected AI service interprets, processes or uses such data in a response. In particular, CERTENTIC does not warrant the accuracy, completeness or suitability of responses generated by an AI service.

Section 4 Open Beta

1. CERTENTIC Bridge is provided free of charge during the Open Beta phase.
2. The Open Beta is intended in particular for testing, further development and improvement of the service under real-world conditions.
3. Features may be added, changed, restricted or removed during the Open Beta.
4. CERTENTIC may discontinue the Open Beta as a whole or for individual users where this is reasonable, taking into account the interests of the users concerned.
5. There is no entitlement to the continued availability of particular Beta features or to CERTENTIC Bridge remaining available free of charge.
6. Any future paid use requires a separate agreement. Participation in the Open Beta will not automatically convert into a paid contractual relationship.

Section 5 Registration and Requirements

1. To use CERTENTIC Bridge, you need a CERTENTIC user account.
2. Registration may take place in advance through a registration function provided by CERTENTIC or as part of the connection process of a supported AI service or supported application.
3. As part of the registration process, you must in particular:
   • provide and verify a valid contact email address;
   • provide all required information completely and accurately;
   • provide the legal confirmations required for registration; and
   • provide the credentials required to use the desired data source.
4. To use CERTENTIC Bridge with iCloud, you need a suitable Apple Account and an app-specific password generated by Apple.
5. Never provide CERTENTIC with your normal Apple Account password. CERTENTIC requires only a suitable app-specific password for CERTENTIC Bridge.
6. You are responsible for ensuring that you are authorised to use the connected accounts and the data accessible through them.
7. You must not connect or access accounts, credentials or data belonging to third parties without the appropriate authorisation.
8. You can revoke an app-specific password used for CERTENTIC Bridge using the functions provided by Apple.

Section 6 Connection to AI Services and Authorisation

1. A supported AI service or supported application is connected to CERTENTIC Bridge through an OAuth-based authorisation process.
2. For this purpose, you are redirected from the relevant AI service or application to CERTENTIC Bridge. There you can review and authorise the requested connection.
3. CERTENTIC Bridge currently provides only the read-only access to supported data sources required for the functions offered.
4. An authorisation applies only to the particular connected AI service or application and the permissions granted for it.
5. The relevant AI service or application may revoke the OAuth permissions issued for the connection in accordance with the supported OAuth procedure. You may also terminate your CERTENTIC user account in accordance with Section 14. Termination of the user account ends the ability to use CERTENTIC Bridge through the OAuth authorisations associated with that account.
6. CERTENTIC may deactivate authorisations or connections where this is necessary for security reasons, to prevent misuse, due to suspension or termination of the user account, or for other reasons permitted under these Terms of Use. Section 14 remains unaffected.
7. The termination or technical invalidation of an individual authorisation does not automatically result in the deletion of your CERTENTIC user account.

Section 7 Permitted Use

1. You may use CERTENTIC Bridge only lawfully and in accordance with these Terms of Use.
2. In particular, you must not use CERTENTIC Bridge:
   • for unlawful purposes;
   • to gain unauthorised access to third-party accounts or data;
   • to circumvent security or access restrictions;
   • to impair the security, stability or availability of the service;
   • to overload the technical infrastructure through automated or abusive use;
   • to investigate, exploit or disclose security vulnerabilities with harmful intent; or
   • in a manner that infringes the rights of third parties.
3. Security research permitted by law and mandatory statutory rights remain unaffected.

Section 8 Fair Use

1. During the Open Beta, CERTENTIC Bridge is provided for reasonable, ordinary use.
2. CERTENTIC may apply reasonable technical usage limits, in particular to ensure the availability and security of the service for all users and to prevent abusive or exceptionally resource-intensive use.
3. Such measures may in particular limit request rates, simultaneous connections or other technical resources.
4. CERTENTIC will take the legitimate interests of users appropriately into account when applying such measures.

Section 9 Processing and Transmission of Content

1. If you initiate a request through a connected AI service that requires data from a connected data source, CERTENTIC Bridge retrieves the data required for that request.
2. The data required to process the particular request is transmitted through CERTENTIC Bridge to the AI service connected by you.
3. In the case of iCloud, this may include Mail and Calendar data depending on the request.
4. CERTENTIC Bridge does not permanently store Mail or Calendar content retrieved from iCloud as part of such a request or the resulting output returned to the AI service.
5. Further processing of data transmitted to the connected AI service is governed by the contractual terms and privacy policies of the respective provider.
6. You are responsible for connecting an AI service to CERTENTIC Bridge and having data transmitted to that service only where you are authorised to do so.

Section 10 Third-Party Services

1. CERTENTIC Bridge relies on third-party services for certain functions. These include, in particular, data sources and AI services connected by the user.
2. The respective provider is responsible for the availability, functionality and terms applicable to such third-party services.
3. Changes, restrictions or outages affecting a third-party provider may result in individual functions of CERTENTIC Bridge becoming temporarily or permanently unavailable.
4. CERTENTIC is not obliged to maintain compatibility with any particular third-party provider on a permanent basis.

Section 11 Availability and Changes to the Service

1. CERTENTIC endeavours to operate CERTENTIC Bridge reliably.
2. During the Open Beta, however, there is no entitlement to any particular level of availability, response time or service level, unless mandatory statutory provisions provide otherwise.
3. CERTENTIC may temporarily restrict the service, in particular for maintenance, security measures, troubleshooting or technical changes.
4. CERTENTIC may change, add or remove functions where there is an objective reason for doing so. Such reasons include, in particular, technical developments, security requirements, changes to third-party services, legal requirements or further development of the product concept.
5. Mandatory statutory rights of users remain unaffected.

Section 12 No Guarantee of Results

1. CERTENTIC Bridge serves to technically provide and transmit data to the AI service selected by the user.
2. Responses and other outputs from an AI service are generated by that provider and are outside CERTENTIC’s control.
3. AI-generated outputs may, in particular, be incomplete, inaccurate or erroneous.
4. You are responsible for reviewing outputs before using them where this is appropriate in view of the nature and significance of the intended use.
5. CERTENTIC Bridge is not intended to be used, without appropriate human review, as the sole basis for decisions having significant legal, financial, medical or comparable consequences.

Section 13 User Responsibilities

1. You are responsible for the security of the accounts and credentials you use.
2. You must inform CERTENTIC without undue delay if you have reason to believe that your user account or connection to CERTENTIC Bridge is being used without authorisation.
3. You are responsible for using third-party services in accordance with the respective terms applicable to them.
4. You are also responsible for ensuring that any processing and transmission of data initiated by you through CERTENTIC Bridge is lawful.

Section 14 Suspension, Termination and User Account

1. You may stop using CERTENTIC Bridge and request termination of your user account in accordance with the procedures provided by CERTENTIC for this purpose.
2. CERTENTIC may temporarily suspend or restrict your user account or its use if there are specific indications of misuse, a material breach of these Terms of Use, or a threat to the security or stability of the service.
3. CERTENTIC may terminate the contract during the free Open Beta by giving reasonable notice. The right to terminate without notice for good cause remains unaffected.
4. Upon termination of the user account, the iCloud credentials stored by CERTENTIC will be removed and the user account will be deactivated.
5. Authorisations and connections to supported AI services and applications associated with the user account will be deactivated and can no longer be used to access CERTENTIC Bridge.
6. Technical OAuth and security records do not necessarily have to be physically deleted at the time of deactivation. Data that is no longer required will be deleted in accordance with the applicable lifecycle and cleanup rules. Statutory retention obligations and storage required for the establishment, exercise or defence of legal claims remain unaffected.
7. Further details regarding the processing and deletion of personal data are set out in the Privacy Policy.

Section 15 Liability

1. CERTENTIC is liable without limitation in cases of intent and gross negligence and for damages arising from injury to life, body or health.
2. In the event of a slightly negligent breach of a material contractual obligation, CERTENTIC’s liability is limited to the damage that is typical for the contract and reasonably foreseeable. Material contractual obligations are obligations whose performance is essential for the proper performance of the contract and on whose performance the user may regularly rely.
3. In all other respects, CERTENTIC’s liability for slight negligence is excluded to the extent permitted by law.
4. Liability under the German Product Liability Act (Produkthaftungsgesetz) and any other mandatory statutory liability remains unaffected.
5. To the extent that CERTENTIC Bridge is provided free of charge as part of the Open Beta, mandatory statutory liability provisions applicable to services provided free of charge remain unaffected.

Section 17 Changes to these Terms of Use

1. CERTENTIC may amend these Terms of Use where there is an objective reason for doing so, in particular due to legal or technical changes, security requirements, changes to the scope of the service or further development of CERTENTIC Bridge.
2. Where an amendment materially affects an existing contractual relationship, CERTENTIC will inform users of the amendment in an appropriate manner.
3. Amendments that require the user’s express consent will not become effective solely on the basis of this amendment clause.
4. Mandatory statutory rights remain unaffected.

Section 18 Governing Law

1. The laws of the Federal Republic of Germany apply, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).
2. If you are a consumer and have your habitual residence in another country, mandatory consumer protection provisions of that country remain unaffected.
3. To the extent permitted by law, and where the user is a merchant (Kaufmann), a legal entity under public law or a special fund under public law, the registered office of CERTENTIC shall be the place of jurisdiction.
4. These Terms of Use may also be made available in other languages. In the event of inconsistencies, the German version shall prevail to the extent permitted by law.
